Walmart operates automated license plate reader ("ALPR") cameras in the parking lots of many of its stores. These cameras automatically photograph and record the license plate of every vehicle that enters, capturing the plate number, along with the date, time, and location of your visit.
California's Automated License Plate Recognition law, Cal. Civ. Code § 1798.90.5 et seq., requires any company that operates ALPR cameras or uses ALPR data to implement and publicly post a usage and privacy policy that meets specific statutory requirements. The law provides that individuals harmed by a violation may recover statutory damages of $2,500 per violation, without having to prove the data was misused.
